In addition to proving the other car is at fault and you sustained damages (medical bills, lost wages, pain and suffering), you must also prove causation. Causation is the nexus or connection between fault and damages. Thus, the sooner in time that you complain about injury and see a doctor, then the stronger the causation is in the case. Causation is often spoken about in terms of car damage – the bigger the accident, the more likely the injuries claimed will be deemed related by the fact finder.
The Florida legislature passed a law that basically says you must go to hospital or to a doctor (and complain of injuries from the car accident) within 14 days; otherwise, your pip carrier does not have to pay your medical bills. You could still have a case but the case would be more difficult.
