Do I Have to See a Medical Doctor Following a Car Accident in Order to Have a Personal Injury Case?

Generally, there is no requirement mandating that you see a medical doctor to have an injury case. The reason is because in Florida there are other types of physicians that could testify for you and prove your case. For example, a doctor of osteopathic services could testify for you. Also, a chiropractor could testify on your behalf. Even an acupuncture physician could testify for you.

Generally speaking, some expert testimony is required in personal injury cases. For example, in order to get medical testimony into evidence. Also, in a car accident, generally you must prove a “permanent injury” in order to recovery non-economic damages like pain and suffering and a physician would generally be required to prove permanent injuries. While a medical doctor’s testimony might be considered the strongest professional to prove a permanent injury, other types of doctors are generally able to prove it also and thus a medical doctor would not be someone’s only option.

Of course, every case is unique and has to be judged based on the specific facts of the case. The advice in this blog is intended to be general in nature and should not to be construed as specific advice for a case, as any difference in the facts could change the result. Also, this blog is based on Florida law and the laws of any other states or some other country could vary significantly from Florida.
