People do not understand that when they are injured in an accident, their spouse can also legally sue for what is known as consortium damages. In other words, the spouse is also injured as a result of the accident in that the marriage is affected (we cannot dance anymore as we did before the accident, spousal relations are impacted, etc.). Thus, the insurance company when they are resolving a case would like to have complete closure of the case. In theory, if the husband is injured in an accident and the case resolved and only he signs the release, then the wife could file a lawsuit thereafter and seek consortium damages legally. Oftentimes, the consortium damages are not worth a whole lot. That would be determined by the injury and case to case. And certainly there could be injuries and cases in which the consortium damages are substantial.
