Yes. You can make an aggravation of injury case in that scenario. And sometimes that case can be better (or easier to prove) than someone who has never had a neck injury and now has the same injury. When you have a prior injury, a neck injury for example, we are able to get those prior records which give a baseline. So if your prior injury shows that a year before the accident, the client had an MRI which shows the injury at one level of the neck but now after the accident, an MRI of the neck shows a new injury at a different level and/or a larger injury at the same level, then there may be strong argument to show that the new or larger injury was definitively caused by the accident. Thus, if you believe that your accident has aggravated a prior injury, you may want to make that part of your injury case.
