Generally, we prove permanent injury through medical testimony in car accident cases. In other words, the doctor needs to testify that he or she believes that the client sustained a permanent injury within a reasonable degree of medical probability. There are two things that are very important in car accident cases as to this issue. First is having diagnostic tests, like x-rays, MRIs, nerve condition studies, and so forth. Doctors decide what diagnostic tests are needed. And some doctors are more liberal in ordering tests than other doctors. The second thing that is very important is assigning a permanent injury rating. Again, that is up to the doctor and some doctors are more liberal in assigning permanent injury ratings. By having diagnostic tests, it generally makes the finding of permanent injury easier for the doctor to do (and conversely more difficult for the defense doctor to make a contrary finding). Thus, the choice of the doctor in any accident case is very important as you want a doctor that will diagnose the injuries, have testing done to help prove the injury and have ammunition to help them report about the injury and assign a permanent injury rating per the AMA guidelines.
