The short and simple answer is: yes. In Florida, there is a presumption of fault against the car from behind in a rear end collision but this presumption can be rebutted by evidence that the car changed into your lane or suddenly stopped, for example. But if the facts are that a car was stopped and another car hits the rear of the car, then the presumption would be that the car from behind is at fault.
