Florida’s No Fault laws generally require everyone to carry PIP coverage on their car insurance. That PIP coverage pays for 60 percent of lost wages, so long as you give sufficient proof (wage verification form by employer and disability note from your treating doctor). Your PIP will pay that claim generally within 30 days. If you are at fault in the accident, that is all that you will be able to collect. If someone else is at fault, you are able to collect the other 40 percent from them.

Also, Florida law does allow you to not carry the wage coverage as part of your PIP (and thus lessen your auto insurance bills). If you have excluded the wage coverage, then your only recourse would be against the other driver and their insurance, assuming they have bodily injury coverage.
