My car went in for a tire rotation. As I was leaving the mechanic shop, one of my wheels fell off and I collided with another vehicle, causing injury to me and the other driver. Do I have a case against the mechanic shop?

Please accept this blog response to a most interesting fact pattern.

While generally car accidents are caused by one of the drivers of the vehicles involved, as you can see here, it is possible for a third party to be fully or partly at fault.  Here, if the mechanic forgot to put the lug nuts on the car, this very likely would be considered negligence by the jury.  The mechanic shop could argue that the driver of the car should have looked to be sure the lug nuts were on but that seems to be a pretty questionable argument.  Thus, it would appear that most if not all the negligence for the accident is the mechanic shop and that would apply to any injuries from the person driving the car as well as the driver or passengers of the other car.
