The basic answer is sometimes you do have to repay your own automobile insurance company the monies they have paid out for medical payment coverage. Medical payments is different, in Florida, from Personal Injury Protection or PIP. Generally, in Florida there is no right for the automobile insurance company to be reimbursed for payment of medical bills under PIP policies. However, if you ALSO have medical payment coverage, which generally pays your 20 percent copays that PIP does not pay, there MAY be a right to reimbursement. It would depend on how the policy reads. It is important to understand that you only have to pay back the monies to the automobile carrier for medical payments IF YOU RECOVER MONEY FROM THE VEHICLE THAT CAUSED THE ACCIDENT. In other words, if you don’t make an injury claim, you do not have to pay back the monies.
