I was injured in an accident and the car that caused the accident fled the scene and the police could not find them (hit and run); is this a case? how much is a case like that worth?

Today’s topic comes from the accident lawyer in Boca Raton (injury attorney Miami, accident lawyer Doral, injury lawyer Hialeah, accident attorney Aventura, accident lawyer Coconut Grove).

Generally, in order to have a case for personal injuries, you would need someone to sue. In the fact pattern above, the at fault vehicle fled the scene and is gone and thus there is no one to sue. However, under Florida law, if there is applicable uninsured motorist (UM) coverage, then you may be able to make a claim against the applicable UM coverage. UM coverage, which is also underinsured motorist (UIM) coverage pays you money when you are in an accident and the other car has no insurance, the other car does not have enough insurance, or the other cars flees the scene, like the fact pattern here. This is why it is important to have uninsured motorist (UM/UIM) coverage, so if you are in a situation like this, that you would be able to have a case.

So to answer the questions above, if the injured person has UM/UIM insurance (and it could be by the injured person having their own car insurance with it, by the car you are in having UM insurance, or possibly if someone who you live with and are related to has UM coverage), then you may have a case. In terms of what a case like that would be worth, it would be based on the injuries and actual monetary value would be based on many factors, like medical bills, diagnostic tests, injury, etc.

Of course, a case based on a fact pattern such as the one above is unique and any other case should be judged based on the specific facts of the case. The advice in this blog is intended to be general and should not to be used as specific advice for a case, as the slightest difference in the facts could change the result. Also, this blog is, as the web site name suggests, based on Florida law and the laws of any other state could vary significantly from Florida.
