I was in a car accident and my own car insurance keeps calling me and asking for a statement; am I required to give them a statement?

Generally, in Florida, a car insurance policy has provisions which require you to give statements and otherwise cooperate with YOUR insurance company (sometimes an insurance company will even request an examination under oath, called an EUO, which is a sworn statement or essentially a deposition without a court case pending). The policy of the particular insurance must be read to determine exactly what the policy requires. Thus, if your own insurance company is calling you to ask questions about the accident, they are entitled to do so and you may be breaching the insurance policy/contract if you refuse to contact the insurance company and give the statement. Now, you do not have to give it at the moment they call and you certainly are entitled to have your own lawyer prepare you and be on the statement with you.

Note that if the other insurance company is calling you, that you generally do NOT have to give a statement to the OTHER insurance company of the car involved in the accident. There may be practical reasons to give it to them, for example if you are trying to get your car fixed through them and that have been unable to confirm liability against their insurance for some reason or another. Again, you are entitled to speak with a lawyer and have that lawyer prepare you for the recorded statements and in my experiences the insurance company often will agree to such statements to be unrecorded, which clearly would be a better alternative.
