Generally, if you make a claim and recover monies for the injuries sustained in an accident (car accident, slip and fall, etc.), under Florida law and Federal laws, you have to repay your health insurance company. It is possible that the policy would not have subrogation language needed for this to exist by in the vast majority of the policies there is such a provision. It is important to note that you have to repay the health insurance ONLY IF YOU RECOVER MONIES FOR YOUR INJURIES. In other words, you do not have to repay health insurance IF YOU DO NOT HAVE A CASE.
